The growth charts and percentile comparisons are based on World Health Organization (WHO) data and are intended for general reference only. You should always consult with a qualified healthcare provider regarding any questions about your baby’s health, growth, or development. Never disregard professional medical advice or delay seeking it because of information provided by this app.

NO WARRANTIES: The app is provided “as is” and “as available” without any warranties of any kind, either express or implied. We do not warrant that the app will be error-free, secure, or available at all times. We do not guarantee the accuracy, completeness, or reliability of any data, including WHO growth standards.

AGE RESTRICTION: This app is not intended for use by persons under 18 years of age. By using this app, you represent that you are at least 18 years old and have legal capacity to enter into this agreement.

SUMMARY OF KEY POINTS

What personal information do we process? We process minimal personal information. When you use the My Baby Growth Charts app, all data you enter (baby profiles, measurements, notes) is stored exclusively on your device and in your personal iCloud account. We do not collect, access, or store this data on our servers.

Do we process any sensitive personal information? The app processes health-related information (baby growth measurements such as weight, length/height) that you voluntarily enter into the app. This sensitive data is stored exclusively on your device and synchronized to your personal iCloud account. We do not have access to this information.

Do we receive any information from third parties? No, we do not receive any information from third parties.

How do we process your information? All processing of your baby’s health data occurs locally on your device. If you enable iCloud, your data is synchronized across your devices using Apple’s iCloud infrastructure, which is governed by Apple’s privacy policies and terms of service.

Do we share personal information with third parties? No. We do not share, sell, rent, or disclose your baby’s health information to any third parties. Your data remains exclusively on your device and in your personal iCloud account.

How do we keep your information safe? Your data security depends on: (1) iOS security features on your device, (2) Apple’s iCloud security if you use synchronization, and (3) your protection of your Apple ID credentials. We do not store your health data on our servers and therefore cannot be responsible for its security beyond the design of the app itself.

What are your rights? You have complete control over your data within the app. You can view, edit, and delete all information at any time. Since we do not collect or store your health data, privacy rights requests should be directed to Apple regarding iCloud data.

1. WHAT INFORMATION DO WE COLLECT?

Data You Enter Into The App

When you use the My Baby Growth Charts application, you may enter the following information:

  • Baby profile information (name, birth date, gender)
  • Growth measurements (weight, length/height, measurement dates)
  • Optional notes attached to measurements

IMPORTANT: All this data is stored exclusively on your device and, if you enable iCloud synchronization, in your personal iCloud account. We do not collect, receive, transmit to our servers, or have any access to this information.

Data We Do NOT Collect

We do not collect:

  • Location data
  • Device identifiers or advertising IDs
  • Usage analytics or telemetry
  • Crash reports (unless you explicitly submit feedback to us)
  • Email addresses (except if you contact us for support)
  • Payment information (the app does not include in-app purchases requiring payment)
  • Photos or camera access
  • Contacts or address book data
  • Any other personal information beyond what you voluntarily provide when contacting us for support

Contact Information

If you contact us via email for support, we may collect your email address and the content of your communication. This information is used solely to respond to your inquiry and is not linked to any health data stored in the app.

2. HOW DO WE PROCESS YOUR INFORMATION?

Local Processing Only

All processing of your baby’s growth data occurs locally on your device. The app:

  • Stores data in the app’s local database on your device
  • Calculates growth percentiles based on WHO standards (data included with the app)
  • Displays growth charts using your entered data
  • If iCloud is enabled, synchronizes data to your personal iCloud account using Apple’s CloudKit framework

We Do Not Process Your Data

Since we do not have access to your baby’s health information, we do not process it for any purpose. The app functions entirely offline and does not transmit health data to our servers.

Apple’s Role as Data Processor

If you use iCloud synchronization, Apple Inc. acts as a data processor for your information under Apple’s iCloud terms of service. Your data is subject to Apple’s Privacy Policy, available at https://www.apple.com/legal/privacy/. We have no control over or access to data stored in your iCloud account.

If you are located in the EU, UK, or Switzerland:

Since we do not collect or process your baby’s health data (it remains on your device and in your iCloud account), the primary data controller for your health information is you, the user. Apple may be considered a data processor if you use iCloud.

For any limited information we may collect (such as support communications):

  • Consent: By contacting us, you consent to our use of your email address to respond to your inquiry
  • Legitimate Interests: We have a legitimate interest in responding to user inquiries and improving our Services
  • Legal Obligations: We may process information to comply with applicable laws

You may withdraw consent at any time by ceasing to use our Services or by requesting deletion of any support communications.

If you are located in Canada:

Similar principles apply. Since we do not collect your health data, express consent is provided by your voluntary use of the app on your device. You can withdraw consent at any time by deleting the app.

4. DATA SHARING AND DISCLOSURE

We Do Not Share Your Health Data

We do not share, sell, rent, trade, or disclose your baby’s health information to any third parties because we do not have access to it. Your data remains exclusively on your device and in your personal iCloud account.

Limited Circumstances for Other Information

We may disclose limited non-health information in the following circumstances:

  • Legal Requirements: If required by law, court order, or government regulation
  • Business Transfers: In connection with a merger, acquisition, or sale of assets (though no health data would be transferred as we do not possess it)
  • Protection of Rights: To protect our legal rights, property, or safety, or that of others

5. DATA RETENTION

Health Data Retention

Your baby’s growth data is retained on your device and in your iCloud account for as long as you choose to keep it. You have complete control over retention:

  • Delete individual measurements within the app
  • Delete entire baby profiles within the app
  • Delete the app to remove all local data from your device
  • Manage iCloud data through your iCloud settings or by disabling iCloud for the app

Our Data Retention

For any support communications, we retain your email and correspondence for as long as necessary to respond to your inquiry and maintain records of customer service interactions, typically no longer than 2 years.

6. DATA SECURITY

Your Responsibility

The security of your data depends primarily on:

  1. Device Security: Protecting your iOS device with a passcode, Touch ID, or Face ID
  2. Apple ID Security: Using a strong password and enabling two-factor authentication for your Apple ID
  3. Physical Security: Preventing unauthorized physical access to your device

Our Security Measures

We design the app using Apple’s recommended security practices:

  • Data stored in iOS-encrypted storage
  • Use of Apple’s CloudKit framework for iCloud synchronization (if enabled)
  • No transmission of health data to third-party servers
  • No embedded third-party analytics or tracking SDKs

No Absolute Security

IMPORTANT: No method of electronic storage or transmission is 100% secure. While we implement reasonable security measures in the app’s design, we cannot guarantee absolute security. You use the app at your own risk. We are not liable for unauthorized access to your device or iCloud account resulting from:

  • Loss or theft of your device
  • Compromise of your Apple ID credentials
  • Security vulnerabilities in iOS or iCloud systems
  • Other circumstances beyond our reasonable control

7. YOUR PRIVACY RIGHTS

Complete Control Over Your Data

Since all your data is stored on your device and in your personal iCloud account, you have complete control:

  • Access: View all data within the app at any time
  • Rectification: Edit measurements, notes, and baby profiles within the app
  • Erasure: Delete individual entries or all data within the app
  • Data Portability: Your data is stored in your iCloud account and follows Apple’s data portability standards

Regional Privacy Rights

European Economic Area (EEA), United Kingdom, and Switzerland: If you are located in the EEA, UK, or Switzerland, you have rights under GDPR and UK GDPR. Since we do not process your health data, most rights should be exercised through the app itself or through Apple regarding iCloud data. You have the right to lodge a complaint with your supervisory authority:

California Residents: Under the California Consumer Privacy Act (CCPA), California residents have specific rights. However, since we do not collect or sell personal information through the app, most CCPA provisions do not apply. If you contact us for support, you may request disclosure of what information we collected about you.

Other Jurisdictions: Users in other jurisdictions may have privacy rights under local laws. Contact us at privacy@appseez.com to exercise your rights.

8. CHILDREN’S PRIVACY

This app is intended for use by parents, guardians, and healthcare providers who are at least 18 years of age. The app is not directed to children under 13, and we do not knowingly collect information from children under 13. While the app stores information about babies and children (entered by adult users), this is done locally on the adult user’s device.

If you are under 18 years of age, you must have permission from your parent or legal guardian to use this app.

9. INTERNATIONAL DATA TRANSFERS

Since all health data is stored on your device and in your personal iCloud account, any international data transfers are governed by Apple’s policies. If you use iCloud and travel internationally or relocate, your data may be transferred to iCloud servers in different regions according to Apple’s infrastructure and policies.

We do not transfer your health data internationally because we do not have access to it.

10. THIRD-PARTY SERVICES

Apple iCloud

If you enable iCloud synchronization, your data is transmitted to and stored in Apple’s iCloud service. This is governed by:

World Health Organization (WHO) Data

The app includes WHO Child Growth Standards data. This data is embedded in the app for offline use. We do not transmit your baby’s measurements to WHO or any external service for comparison. All percentile calculations occur locally on your device.

No Other Third Parties

The app does not include:

  • Analytics services (e.g., Google Analytics, Firebase)
  • Advertising networks
  • Social media integrations
  • Payment processors
  • Other third-party SDKs or services

11. DO-NOT-TRACK SIGNALS

The app does not track your online activities and does not respond to Do-Not-Track (DNT) signals because it does not engage in tracking.

12. UPDATES TO THIS PRIVACY NOTICE

We may update this privacy notice from time to time to reflect changes in our practices or for legal, regulatory, or operational reasons. The updated version will be indicated by the “Last updated” date at the top of this notice.

Material changes will be communicated through:

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any damages arising from your use of the app, including but not limited to loss of data, medical decisions based on app information, or security breaches of your device or iCloud account
  • We are not responsible for the accuracy, reliability, or completeness of WHO growth standards or percentile calculations
  • We are not liable for Apple’s iCloud service, including data loss, service interruptions, or security incidents
  • The app is provided “as is” without warranties of any kind

This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory.

14. GOVERNING LAW AND JURISDICTION

This privacy notice and any disputes arising from it shall be governed by the laws of Switzerland, without regard to conflict of law principles.

For users in the European Union, nothing in this clause affects your rights as a consumer under mandatory consumer protection laws in your country of residence.

Since all your baby’s health data is stored on your device and in your personal iCloud account:

  • Access your data: Open the app and view all stored information
  • Correct your data: Edit measurements, notes, or baby profiles within the app
  • Delete your data:
    • Delete individual measurements or notes within the app
    • Delete entire baby profiles within the app
    • Delete the app to remove all local data from your device
    • Disable iCloud for the app or delete iCloud data through iOS Settings
